Q: What should I do in the event of an accident?
A: At the scene of an accident, it can be stressful. Try to remain calm and get down as much
information as possible. Get all of the details of the other car and driver. If you have a
camera phone, take pictures of the damaged cars, and where they have ended up after the
collision. Please feel free to download our accident claim form and complete for us to
consider for you.
Q: What if I am uninsured?
A: If you are uninsured, you will still have a right of recovery against the other party or his
insurance, if you are right, or mostly right. Often, determining who is right and wrong is a job
for those with experience in such matters. We are happy to assist you here. If you are in the
wrong, you may have to pay the other party’s losses. Again, we are happy to help you
negotiate, if you are being pursued by the other party or his insurer.
Q: What can I recover in the event of an accident?
A: You are entitled to recover those losses that are a “foreseeable consequence” of the
incident. Eg if you are a Taxi, you are entitled to a claim for lost earnings for the repair time,
subject to proof. If you are uncertain as to what else you might be able to claim, we
suggest you obtain our further advice.
Q: What if there is a dispute about who is right or wrong?
A: This is the sort of answer that only an advocate experienced in such claims can advise upon.
Again, the more information that is available about the incident, the better.
